Cook Pecan Company, Inc. (“Cook Pecan”), filed suit against William McDaniel, alleging that McDaniel refused to allow Cook Pecan to harvest crops on land owned by McDaniel in violation of the parties’ agreement. Cook Pecan appeals from the superior court’s grant of summary judgment to McDaniel and argues that the superior court erred in its review of McDaniel’s summary judgment motion and in concluding that Cook Pecan failed properly to amend its complaint to assert claims for unjust enrichment and quantum meruit.
