This action is brought by the city of New York against the defendant, a street railway company, to recover the sum of $14,692.07 as the cost of paving a section of First avenue, between Thirtieth street and Thirty-fourth street, in the borough of Manhattan, pursuant to. the provisions of section 178 of the Railroad Law.
