| ^Plaintiff, Michael McGrew, appeals a summary judgment rendered in favor of defendant, Dr. Paul J. Waguespack, dismissing this medical malpractice action with prejudice. We affirm in part, reverse in part, and remand.

BACKGROUND

On July 11, 2012, Mr. McGrew filed a malpractice lawsuit against Dr. Wagues-pack. In the petition, Mr. McGrew alleged that in April 2010, he sought treatment from Dr. Waguespack, who performed back surgery on him.
