1Opinion of the CourtPerkins, J.

Mary Arnold sued the makers thereof upon a promissory note, in terms as follows:

“ $1,000. • July 29th, 1878.
“ Twelve mouths after date we promise to pay to the order of Mary Arnold, negotiable and payable at the First Rational Bank of Shelbyville, Indiana, one thousand dollars, with interest at the rate of ten per cent, per annum from date, and with attorney’s fees if suit be instituted on this note. Value received, without any relief from valuation or appraisement. The drawers and endorsers severally waive presentment for payment, and notice of protest for non-payment of this note. Bennett…
