MEMORANDUM OPINION

The matter presently before the Court is a Petition for Contempt filed on behalf of debtor, Penn Terra Limited, against the Commonwealth of Pennsylvania Department of Environmental Resources, hereinafter “DER.” The Petition for Contempt arises from DER’s continued pursuit of a mandatory injunction against debtor in Commonwealth Court of Pennsylvania seeking debtor’s expenditure of funds for correction of its violations of the Pennsylvania Clean Streams Act and Surface Mining Conservation and Reclamation Act.
