KINSER JANUARY 10, 2013 COMMONWEALTH OF VIRGINIA FROM THE CIRCUIT COURT OF FAIRFAX COUNTY Charles J. Maxfield, Judge In this appeal challenging a denial of expungement of police and court records, we conclude that a possession of marijuana charge, amended to a reckless driving charge, was "otherwise dismissed" as contemplated by Code § 19.2- 392.2(A)(2).
