BOEHM, Justice.

Timothy Farber was convicted of murder and robbery. The State sought a sentence of life imprisonment without parole alleging that Farber had intentionally killed while committing a robbery. A jury recommended against life without parole but the trial court nevertheless imposed that sentence. Farber was also sentenced to thirty years for robbery. His convic*140tions were affirmed on direct appeal but the case was remanded for a new sentencing order. See Farber v. State, 703 N.E.2d 151, 153 (Ind.1998).
