The defendants were tried under a bill of indictment charging them with the murder of E. J. Swanson. The evidence offered tended to show that Swanson was feloniously slain, and that the murder was committed in the perpetration or attempt to perpetrate a robbery. This brought the offense within the specific language of G-. S., 14-17, and constituted it by force of the statute murder in the first degree. S. v. Alston, 215 N. C., 713, 3 S. E. (2d), 11.
