Ben Hill was convicted on October 24, 1913, in the criminal court of Atlanta of the offense of operating an automobile, *411without the consent or authority of the owner, and was sentenced to serve a term of 8 months in the chain-gang or pay a fine of $50. On Monday, the 24th day of November, 1913, the defendant presented to the judge of Fulton superior court his petition for certiorari, the judge refused to sanction it, and a bill of exceptions was sued out on account of such refusal.
