Maria Josepha Robert, a natural daughter of Genevieve Robert, a free woman of color, was born in New Orleans the 30th of July, 1816, and, with her mother’s consent, went to France in 1822, where she remained until her death, in June 1837. She died unmarried, without descendants.

Appeal from the Court of Probates of the Parish of New Or-, leans, Bermudez, J. This controversy arises out and is the sequel of the ’ case decided by this court between the same parties, and reported in 17 La. 10. The parties went back to the Court of Probates, to proceed on the rule which we thought necessary to notice in our former decision, and which had been taken by the dative testamentary executor, during the progress of the previous litigation before the Commercial Court.
