DECISION

This matter came on for hearing before Mr. Justice Lanphear on September 22, 2008, on Roger and Margo Malouins' motion for summary judgment, as well as Defendants Clay Chipman's and West Warwick's cross-motions.1 After hearing thereon, the Court reserved decision on all Counts and will address each one in turn at this time. Jurisdiction is pursuant to Super.R. Civ. P. Rule 56.
