Motion for leave to reargue the defendant’s motion to transfer a pending criminal action against him to a Magistrate outside the Town of Southold is denied.

The defendant was involved in an automobile accident with a police car of the Southold Town Police Department for which he received a summons for a violation of the Vehicle and Traffic Law. On the return date of the summons a motion was made to have the Justice of the Peace disqualify himself on the theory *137that since the actual owner of the police car was the town, the Justices of the Peace as members of the Town Board of a second class…
