The defendant, Wade Crane, was by information jointly charged with Newt Lawson of the crime of grand larceny. The property alleged to have been stolen was 65 bushels and 30 pounds of wheat, the personal property of Jake Zumwalt. The defendant was tried separately, convicted, and sentenced to serve a term of one year and one day in the state penitentiary. Motion for a new trial was filed, considered, overruled, and the plaintiff in error has appealed. In this opinion, the plaintiff in error will be referred to as the defendant.
