On May 13, 1949, appellant James R. Spellman, as administrator of the estate of Maurice Patrick Murnan, deceased, filed in the Common Pleas Court of Cuyahoga County, Ohio, a petition to vacate a decree of divorce granted to one Grace Daugherty Backenstoe, now deceased. The petition alleged that: such decree of divorce was entered on November 7, 1912 by the Court of Insolvency, Cuyahoga County, Ohio, wherein Grace Backenstoe was granted a divorce from her then husband, George Backenstoe; Grace Backenstoe claimed, prior to her death in November, 1939, to be the wife of…
