This case was originally filed in the Superior Court of Puerto Rico, San Juan Part. It is a typical proceeding for a declaratory judgment and is so entitled by plaintiff. On August 29, 1968 co-defendant United Merchants and Manufacturers, Inc. filed a petition for removal invoking federal jurisdiction under 28 U.S.C. § 1331 and 48 U.S.C. § 863 on the ground that there exists complete diversity of citizenship between the parties on either side and the amount in controversy exceeds the minimum jurisdictional amount, exclusive of interest and costs.
