MEMORANDUM OPINION AND ORDER

PIERSOL, Chief Judge.

Pending before the Court is Plaintiffs Motion to Certify Class Action, Doc. 14. The motion has been fully briefed by the parties and will be decided based upon the written record in this action.

BACKGROUND

This action was brought pursuant to the “Little” Tucker Act, 28 U.S.C. § 1346(a)(2). Plaintiff filed this action seeking an award of money damages for the Defendant’s breach of trust in unreasonably delaying the distribution of a judgment fund, which resulted in Plaintiffs share in the fund being decreased by 28.3995% when Congress enacted the…
