Severson & Werson, P.C. v. Sepehry-Fard
California Court of Appeal, 5th District
1Opinion of the CourtGreenwood, P.J.
*842*942The trial court issued a workplace violence restraining order under Code of Civil Procedure section 527.8 against appellant Fareed Sepehry-Fard on four days' notice without an accompanying order shortening time. We conclude the five days' notice requirement of section 527.8 is jurisdictional and renders the court's resulting order void in the absence of the party who did not receive the five days' notice. We will reverse the order accordingly.1
