The primary issue before us is whether dismissal of a civil forfeiture action brought under 21 U.S.C. § 881 (1982' & Supp. Ill 1985) because of the refusal of the United States to amend its complaint bars a later criminal forfeiture proceeding brought under 21 U.S.C. §§ 848 (1982 & Supp. Ill 1985), 853 (Supp. Ill 1985). Both forfeitures involved essentially the same property. The district court held that dismissal of the civil forfeiture did not bar the criminal forfeiture.
