This is an article 78 proceeding to annul the order of the respondent denying an order to decontrol the subject premises.
*985The petitioner landlord sought decontrol of the ground floor apartment at 192 Powell Street. The original petition was denied on May 14, 1957 and protest denied on August 13, 1957 on the ground that no additional housing accommodations resulted from certain alterations made in the premises (State Rent and Eviction Regulations, § 11).
