Following a trial by jury the defendant was convicted of two counts of the sale of heroin and one count of possession with intent to sell. On the trial the evidence showed that the two sales were made nearly simultaneously, one to each of two undercover police agents. Present at the two sales was a civilian who was variously referred to as ‘1 the informant ”, “a known drug addict ”, or “ the witness ”.
