Appeal by the plaintiff, Town of Oyster Bay, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Nassau on the 17th day of January, 1913, upon the verdict of a jury rendered by direction of the court.

Thomas, J.:
The action is in ejectment to recover a strip of beach land above high-water mark on Long Island sound. The appeal is from a judgment upon a verdict directed for the defendant. The defendant relies (1) upon his own title; (2) upon lack of proven title in the plaintiff. The plaintiff would trace title to Andros patent of September 29,1677, to the town of Oyster *258Bay, which described land bounded by the Long Island sound on the north, by the Atlantic ocean on the south, and by the towns of Huntington and Hempstead, respectively, on the east and west.
