Cross appeals from so much of a judgment of the Supreme Court, entered September 13, 1972 in Albany County, upon a decision of the court at Trial Term, as granted recovery against defendants J. N. Futia Co., Inc., and the Aetna Casualty and Surety Company and dismissed the complaint against all other defendants. Early in 1969 the State contracted with Futia for certain construction work at the State University in Albany.
