MEMORANDUM OPINION

FLAUM, District Judge:

The facts out of which this action arose have been fully set forth by this court. Kalmich v. Bruno, 404 F.Supp. 57, 60-61 (N.D.Ill.1975), rev’d, 553 F.2d 549 (7th Cir. 1977), cert. denied, 434 U.S. 940, 98 S.Ct. 432, 54 L.Ed.2d 300 (1977). In brief, plaintiff seeks recovery from defendant for the confiscation of his property in Yugoslavia by the Nazi occupation force in 1941.
