— Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which denied petitioner’s application for accidental disability retirement benefits.

While leaving the clinic where he was employed, petitioner, a physician, slipped and fell injuring his back. Although petitioner contends that at the time of his injury he was on his way to another facility to see a patient, the record also indicates that petitioner was going out to lunch with his friend.
