The original action in this case was instituted by the lessors of the plaintiff, against the defendant, for the recovery of certain premises in the city of Cincinnati. The declaration was filed on the 14th May, 1845, and is in usual form. This is a case of very considerable importance both on account of the value of the property, and of the principles" involved. It has been argued at great length and with much ability by the counsel concerned, and it is certainly involved in some doubt. It is believed, however, that if *422we apply to it the ordinary rules of law, governing cases of ^is description, there can be no insurmountable difficulty in coming to a decision.
