This was an action to recover damages under the federal employers' liability act. Plaintiff appeals from an order sustaining a demurrer to her second amended petition, referred to hereafter as the petition.

The petition, after alleging appointment and qualification of plaintiff as administratrix of the estate of Alvin A. Haggard, deceased, and that defendants, as trustees, were operating the Chicago, Rock Island and Pacific Railway Company, which was engaged in interstate commerce, and that Alvin A.
