This was an action on the case, brought by Joseph Hoy, defendant in error, against Samuel E. Holtzman, plaintiff in error, to recover damages for the want of ordinary care, caution and skill by Holtzman, as a physician and surgeon, in his management and treatment of the broken leg of Hoy, per quod it failed properly to unite, and united only by an infirm flexible ligament.

The verdict and judgment were against Holtzman for §2,500 damages.
