This was an action brought by the Girard Bank against the Schuylkill Bank to recover $50,000, the amount of three promissory notes, dated in 1839, drawn by the Beaver Meadow Railroad Company in favour of the Schuylkill Bank, and endorsed by H. J. Levis, cashier. The suit was referred to arbitrators under the compulsory arbitration Act, who after a hearing awarded “ a nonsuit of the plaintiff in favour of the defendant.” The plaintiff appealed, and now asks leave of the court to enter a nonsuit under the proviso of the 25th section of the…
