EVIDENCE – EXPERT TESTIMONY A lay witness may recite the contents of a business record—and may draw on his familiarity with the kind of record at issue to do so efficiently—so long as the inference the testimony is offered to support is one an average layperson could draw from the record itself. When, instead, the witness must apply specialized methodology to translate, reformat, or interpret records that are not otherwise decipherable by a layperson, the witness must be qualified as an expert.
