MEMORANDUM OF DECISION AND ORDER
SPATT, District Judge.
Pro Se plaintiff Joseph L. Rainone (“Rainone” or the “Plaintiff’) filed this discrimination action against his employer, the Postmaster General of the United States Postal Service (“USPS” or the “Defendant”) claiming that he was not promoted due to his gender and in retaliation for protected activity. The matter was tried to a jury from July 18, 2005 to July 29, 2005.
