The issue presented is one of first impression in this circuit: whether, in immi gration proceedings, the Attorney General has discretion to deny a petition for adjustment of status under INA § 245(i), 8 U.S.C. § 1255(i), once the petitioner is statutorily eligible for adjustment. After a thorough review, we conclude that the Attorney General has the discretion to deny the adjustment of status.
