The appellee, a sub-contractor, filed its bill in the circuit court of Cook county, against the appellant, as owner, and the Parks-Baldwin Building Company, as the principal contractor, to establish a mechanic’s lien on a certain lot in the city of Chicago for lumber furnished under a parol agreement with the building company at an agreed price, and used in building a house for appellant. The amount remaining unpaid was §1195. The substance of the defense was that the building company had failed to perform its contract and had thereby caused loss to the appellant, and that there was nothing…
