The appellees were indicted in the Boone Circuit Court for trespass upon lands. The essential part of the indictment is as follows: “That Barnard Smith and John Murphy, on the 8th day of October, A. D. 1892, at the county of Boone, and State of' Indiana, did then and there unlawfully enter upon and remove from the lands of George Stephenson, there situate, a certain fence, then and there belonging to said George Stephenson, and constituting a part of said lands, without a license to do so from the said George Stephenson, or from any other competent authority; the said fence being then and…
