Laughlin, J.:

This is an action by the executor of and trustee under the last will and testament of Wallace 0. Andrews, deceased, for a construction of the will of his testator. The will was executed, on the 12th day of November, 1891, and the testator died in the city of New York on the 7th day of April, 1899, leaving real property in the States of New York, New Jersey and Virginia, and certain personal property.
