OPINION BY

KLEIN, J.:

¶ 1 The Commonwealth appeals from a trial court order refusing to relitigate a motion to suppress evidence, which had been granted in a prior federal proceeding on a related charge, and dismissing the felony charges lodged against the defendant. We reverse and remand for further proceedings.

¶ 2 The trial court held that the doctrine of collateral estoppel precluded another hearing on the motion to suppress and dismissed the case. We agree with the Commonwealth that because the prosecuting parties and sovereign interests are different in the two cases, collateral estoppel…
