Byrd Irr. Co. v. Smyth

This was an action by the Byrd Irrigation Company, a corporation, to condemn a tract of land in Uvalde county belonging to J. G. Smyth, appellee, for the purpose of constructing dams, reservoirs, and canals to be used for irrigation purposes under the powers conferred upon it by its charter under chapter 2, title ‘60, of the Revised Statutes. A commission was appointed by the county court, in accordance with the law, to fix the amount of land and assess the damages.
