Appellee, a minor, commenced this action by her next friend in the Howard Circuit Court, to recover damages for personal injuries sustained by her, and alleged to be due to the negligence of appellant. . The cause was venued to the Cass Circuit Court, wherein, on a trial by the court, appellee was awarded the sum of $4,000, and, over appellant’s motion for a new trial, judgment was rendered on the general finding of the court for that amount.
