This is an application for writ of habeas corpus, in which the petitioner, Walter Presnell, seeks to secure his release by order of this court from the custody of the sheriff of Creek county.

It appears from the petition that on or about August 27, 1935, he was arrested upon complaint, charging him with the offense of receiving stolen property. Upon a preliminary examination before E. B.
