BUSSEY, Judge.
The petitioner, Charles L. Pettyjohn, is confined in the State Penitentiary at Mc-Alister, after having entered a plea of guilty in the District Court of Oklahoma County, Oklahoma, to a charge of Burglary in the second degree in case number 25801. The court thereupon sentenced him to serve a term of seven years in the State Penitentiary. On October 19, 1960 the petitioner herein filed in the Court of Criminal Appeals an application for writ of habeas corpus.
