The defendant was charged with two counts of criminal possession of a forged instrument in the second degree and two counts of petit larceny arising out of an incident in which he allegedly cashed two altered money orders for $88.61. The *42defendant’s application to dismiss the indictment in the interest of justice pursuant to CPL 210.40 (1) was granted after a hearing (People v Zagarino, 74 AD2d 115) to the extent that the two felony charges were dismissed.
