This matter is now before the Court on the Motion of the Defendant to strike the Second Amended Petition of the Plaintiff from the records in this cause on the ground that said second Amended Petition is a sham pleading containing therein an allegation false and untrue so far as the Statute of Limitations is concerned, even though said allegation would appear on its face to be a valid allegation in a Petition of this kind. Defendant also claims that such pleading is frivolous, without merit, has not been filed in good faith, and has been filed for the purpose of harrassing…
