In this action for malicious prosecution the defendant Feldman moves for judgment on the pleadings upon the ground that as to him the complaint is insufficient as a matter of law.

The theory of the action is that the defendants, including the moving defendant, conspired to maliciously prosecute the plaintiff. The defendant Feldman is sought to be held responsible for the acts of the other defendants, as one of the conspirators.
