Plaintiff’s husband received injuries while engaged in his employment by defendant as a crossing watchman, resulting in his death on May 19,1919. Deceased, though residing in this country, was a citizen of Austria-Hungary, and at the time of the accident, plaintiff resided in Austria, having gone there with her children in 1914. Claim for compensation was not made until July 20, 1921, more than two years after the date of the accident, but less than a year after the treaty of peace between the United States and Austria was ratified, about October 8, 1920.
