Appeal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered November 19, 2002, convicting defendant upon his *688plea of guilty of the crimes of criminal contempt in the first degree and criminal possession of a controlled substance in the fifth degree.

Defendant pleaded guilty to the crimes of criminal contempt in the first degree and criminal possession of a controlled substance in the fifth degree and waived his right to appeal. Defendant thereafter was sentenced as a second felony offender in accordance with the negotiated plea agreement to concurrent prison terms…
