Petitioners Data Mountain Solutions, Inc. (“DMS”), Frederick S. Hill, Jr., and Derek McUmber seek confirmation under the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq. (“FAA”), of an award issued by arbitrator Michael Kelley on November 14, 2008. In the alternative, if the Court is not yet prepared to render judgment in this matter, they have moved for the entry of a preliminary injunction that would, among other things, limit the light of respondent Gregg Giordano to dissipate his assets.
