On the 31st of October last this court rendered a judgment affirming the judgment of the court below in this cause: The opinion, which was pronounced by Perkins, J., on that occasion, is reported in 22 Ind. 283, et seq. On the 26th of November following, an order was entered here setting aside the judgment of affirmance, and *142continuing, under advisement, the question as to the judgment to be entered.
