People v. Lee

1Opinion of the CourtJustice Freeman

A divided panel of the appellate court held that the Joliet municipal offense of loitering for the purpose of engaging in drug-related activity was facially unconstitutional based on vagueness. As a result, the appellate court reversed the drug possession convictions of defendant, James Lee. 345 Ill. App. 3d 782. Although we agree with the ultimate disposition, we do so on the more limited grounds that the arresting officers lacked probable cause to arrest defendant and, accordingly, do not reach the constitutional question.
