—‘Appeal from an order of the Supreme Court at Special Term, entered September 14, 1972 in Columbia County, which denied defendant’s motion to dismiss the complaint on the ground that it failed to state a cause of action. Respondents seek to recover damages resulting from a fall upon the sidewalk located in front of and abutting appellant’s property located in the City of Hudson, New York. Section 327 of the Charter of the City of Hudson (L. 1921, ch. 669) provides as follows: "§ 327. Duty of owners as to sidewalks.
