_JjThe Defendant, Patrick Levier, was charged by indictment with second degree murder, a violation of La.R.S. 14:30.1. On November 29, 2007, the jury rendered a verdict of guilty as charged in a ten-out-of- twelve decision. On January 28, 2008, the Defendant was sentenced to life imprisonment without the benefit of probation, parole or suspension of sentence.

The Defendant filed a “Motion for Post Verdict Judgment of Acquittal or Modification of Verdict.” After a hearing on the matter, the trial court denied the motion. On appeal, the Defendant asserts the State presented…
