This action was brought by the appellant, Ben C. Allin, in the Mercer circuit court, against the appellees, Mercer County and Fiscal Court of Mercer County, to *567compel the payment by the latter of a claim of $1,100.00 for certain services performed by him as clerk of the Mercer Circuit Court, which will later be specifically set forth and considered in the opinion; it being alleged in the petition that the services referred to were, and are, reasonably worth the sum of $1,100.00, which sum was allowed him by an order of the circuit court and…
